Harman Versus Hastings

I thought Reyes was a done deal a month ago, and nothing has changed my mind about that.

If I were Speaker, I'd consider it a bit of a no-brainer to re-appoint Harman, not because I agree with her on policy, but because she's good on TV. That's a point no one in the blogosphere ever gives a shit about, but which is reliably the most important point in electoral politics.

And since the House has essentially zero control over our actual foreign policy, the choice between appearance and substance here should be, to repeat myself, a bit of a no-brainer.

Yes, picking Reyes is the logical choice. But it will piss off both the hawks and the CBC. Ah well, good compromise makes everyone unhappy, right?

Harman did a stint on TPMCafe last year. She didn't come off as being very bright. Still, I'd go with her over an impeachee.

Harman has, frankly, all the wrong friends -- AIPAC, liberal hawks like Ken Baer, Marty Peretz is taking a personal interest in the matter, etc.

The advantage of passing over Harman would be to show that sometimes there's a price to be paid for having these sorts of friends.

And since the House has essentially zero control over our actual foreign policy, the choice between appearance and substance here should be, to repeat myself, a bit of a no-brainer.

No, it's really not, especially if Bush decides to bomb Iran or Syria some time over the next two years. The House may have very little control over foreign policy, but it can exert plenty of influence over how that policy is perceived, by condemning or legitimizing executive actions. And putting a die-hard hawk with deep ties to military contractors and AIPAC in charge of an intelligence committee will severely limit what that committee actually investigates.

This is the second time in a week I have found myself saying "can't we do better than one of these two?" So barring the revelation of any more dirt, I'm enthusastically in favor of Matt's suggestion that Pelosi elevate Reyes.

In the case of Hoyer vs. Murtha, it wasn't so bad. Murtha is too conservative for my tastes, but has far better views on Iraq and sends precisely the right message to the public following this election about where the Democrats intend to go.

But Harman and Hastings are both totally unacceptable. Hastings is totally wrong because choosing a man with his record of past corruption will destroy overnight the Dems claim that they have come to clean up Washington.

Harman is wrong not because she votes the AIPAC line - as Matt notes that is true of lots of people in Congress, and on his website Hastings himself boasts of a "100% with Israel" voting record - but because she is an actual AIPAC stooge.

Matt wonders why people who follow Israel policy think it is so important to have an AIPAC enforcer at the helm of the intelligence committee. In this case, it should be obvious. Various house investigations of bad pre-war intelligence and disinformation are likely to lead right to AIPAC's door, and they want a loyal foot soldier on the IC to block those investigations. I'm more convinced than ever this is true. Why else would they go to bat so fiercely for Harman, and have their minions out doing hatchet work on Hastings?

Otto is right: somebody has to show that it isn't always beneficial to work for AIPAC.

And Petey ... be serious. I understand as well as anybody the impotance of a telegenic communicator. But the intelligence committee does very important work. And in the upcoming Congress that work will be more important than ever. As the House investigates the intelligence failures and manipulations of 2002 and 2003, or when a fresh new batch of phony intelligence relating to Iran comes down the pipeline in 2007, we can't afford to have an AIPAC tool heading the intelligence committee.

I find this whole implication that Hastings is unfit to serve in the government to be quite insulting and distasteful.

1) He was acquitted of bribery by a jury of his peers which is supposed to be what matters in this country. There is a reason we don't have bills of attainder.

2) The Senate 'convicted' him of the deed a decade after the fact in a politicized trial which most of the votes to 'convict' came from Senators who had not seen the trial. Those who conducted the trial did not vote to convict. The Senate also specifically voted not to strip him of the right to hold federal office in the future.

3) What's more, he was elected to the House -after- this whole brouhaha, so there is simply no case to be made that it dilutes his status as an elected official. The people of his district elected him knowing about the accusations, and it would be unfair to them to say that he's ineligible to earn seniority because of who he was before they elected him.

4) If there is any evidence that Hastings has been ethically compromised in the last 20 years or at any point after being elected to office (like Harman has), let's see it. If there isn't, let's talk about what that means.

Neil, we're not talking about justice. We're talking about politics.

But I'm with Neil, here -- what does it mean to say 'they have the goods on Hastings'? If it means that his appointment will be politically difficult, that's one thing. If it means that he is genuinely ethically compromised, that's another, and on the very limited facts I know, it's not clear to me that that is the case.

Harman is involved in the AIPAC scandal. She is AIPAC's candidate. You need to refine your statement about the New Republic: anything they advocate on national security is advocacy for Israel.

Likewise with other members of the press. I have to use Ruth Marcus of the Post as an example because her tactics are so transparent. Two weeks ago she wrote an op-ed favoring Harman over Hastings, no mention of AIPAC, of course, or more generally, Harman's reticence about exposing intelligence manipulation. Today she writes that Murtha is "Unfit", conspicuously omitting the word "Iraq" from her op-ed.

Don't pussyfoot around the obvious issues here.

Is Ken Baer really a "Liberal Hawk"?

In June 2003, Harman raised concerns about the intel about Iraq WMD in a Washington Post op-ed, and in the days later launched the first congressional probe of pre-war intelligence.
After Abu Ghraib, Harman jumped on the Administration immediately, and then authored a bill which prohibited any government official from engaging in torture, cruel, inhuman, and degrading treatment of prisoners (a version of this became law in the Detainee Treatment Act in 2005).
Harman co-authored with Congressman John Conyers, a bill to require warrants for all electronic surveillance of American on US soil in compliance with FISA. And she authored another bill to require the FISA Court to approve a National Security Letter before it can be submitted to the FBI.
Harman voted against the $87 billion in emergency Iraq war funding in October 2003, outraged over the "blank check" given to the Administration.
And Harman was an integral player in the set-up of the current intel apparatus, while being an incessant critic of Bush for his politicization of intel, lack of plan for Iraq, and mishandling of homeland security.

Doesen't seem to have problems to me.

And please what'sa this "has all the wrong friends?" AIPAC I can understand since their controversial to say the least, but Kenneth Baer? Steny Hoyer? We're not talking Douglas Feith & Tom DeLay here. This is really prejudicial politicial reductionism at it's worst.

Harman must go! Hastings or Reyes are both light years ahead of her. Her stance on NSA and Iraq disqualify her for a leadership position on the intelligence committee. We have to make a statement about competence in government and getting rid of Bush lite Harman is a good start.

I read somewhere (don't have the link) that Pelosi said that this is the one committee where all the members can be reappointed each session. I took that to mean that she can completely change the composition of the committee. Is this true? If so, I wonder if she's considering pulling both Harman and Hastings off the committee, maybe replacing them with better candidates (Sestak seems an obvious choice), and opening up the possibilities for the chairmanship.

To take an example from your argument, you take the fact of her op-ed and Congressional probe into WMD intelligence as evidence of her integrity. Well, shit: we had just invaded Iraq and there were no WMDs. There had to be some investigation; even brutely loyal and stupid Republicans knew that, so they created whitewash investigations or delayed them.

Another example: Abu Ghraib is irrelevant to this argument. You could be an AIPAC stooge and still see the obvious lack of merit (as well as tactical disaster) of setting up a torture regime and dismantling the constitution. Same argument could go for NSA wiretapping.

What Harman doesn't want to come to light is the neocon penetration of our intelligence services, both because it would expose her AIPAC political patrons and allies, and because it might prevent the same apparatus from being brought to bear against Iraq.

Matthew Y.'s point is exactly right: the company you keep is an argument enough.

Somehow I am sceptical of the independence of your judgment about both Baer and Harman, given that you simply copied and pasted Baer's bullet points on Harman from his TPM Cafe posting.

That's "against Iran", not "Iraq".

Perhaps for the benefit of those of us who were not, perhaps, born yet at the time of Hastings' alleged crime, we can revisit the case itself? The full extent of the evidence against Hastings seems to be a suspicious pattern of phone calls to the (convicted) person soliciting the bribe, along with an innocuous-looking phone transcript that prosecutors alleged was non-innocuous code. The jury apparently did not buy that argument (the pattern of phone calls was, of course, not admissible into a real court).

Since a number of Senators voted not to convict Hastings, it seems like the evidence against him is far from bulletproof. But since I have only read about it from second- or third-hand sources, maybe I'm missing something about the optics. Anyone who was paying attention back then want to fill me in?

From what I glean Baer's angle is that the Saudis are really bad, devious and dangerous (no more so than our native plutocrats, as far as I'm concerned). This is one front in the neoconservative war against realpolitik, or, in other words, of putting oil before Israel. Their attempts to broker an Israeli-Palestinian peace don't put them in good stead, either.

So I'm not sure I get exactly why this is the case, but check out what WaPo congressional reporter Shailagh Murray had to say on this question in one of the online chats the other day.

I'll just add I thought Matt was sort of friendly with Baer. I still remember from tmpcafe days the envy you could see online on Baer's face when Matt turned out a speech in about five minutes that put professionals to shame. It was really funny. I'll just add that Baer's post on tpmcafe about Harman looked an awful lot like a carefully crafted piece of campaign literature.

Many people I know here in FL consider Pelosi to be between a rock and a hard place here. Even those of my shul-mates who are very hard-core pro-Israeli find Harmon a bit too close to people who are a bit too close to Bush for their comfort ... and if even generally people who are inclined to not be so anti-AIPAC find Harmon problematic, imagine how other people would feel. OTOH, Hastings evidently is, or at least was, majorly corrupt and not someone wanted to be in any position of authority.

But, it'd look bad for Pelosi to pass up both Harmon and Hastings. Passing up Harmon would at least play well for the Dem. base, but passing up Hastings is a damned if you do, damned if you don't situation: even if Hastings was being passed up for an Hispanic, it only partially counteracts, but does not eliminate the perception of racial bias.

AFAIC, I'd say stick with Harmon. While she has some friends with very disturbing friends and has been known to be frighteningly close to Bush on certain issues, she's also been, at times, a ruthless critic of Bush who plays very well on TV and cannot be demonized as a moonbat (though the right will try) -- in some ways, she's a Congresswoman version of Senator Harry Reid. I would just make it clear that she knows part of her job is to make sure Bush & CO get meaningful oversight and if she doesn't do that job, she'll not only be moved to another committee but she'll also face an incredibly tough primary challenge whenever it's convenient for the Dems. to do so. A 527 could "happen" to get involved.

Heck, if GOoPers that didn't toe the party line could magically face challenges from the "Club for Growth", why can't we play the same hardball in enforcing political order in our party? A 527 like the one S Daniel Abraham used in the Iowa primary to blow a hole in Howard Dean's campaign -- after Dean stated in a debate with Joe Lieberman that the US government needed to be evenhanded in the Israeli-Palestinian issue??

The Oct 20 Time article noted that Haim Saban was lobbying Pelosi on Harman's behalf. I assume you know who Saban is --if not, look at my comments on Baer's TPMCafe article. Assuming they are visible and not down because of "technical glitches".

Hastings is not corrupt. The majority of the Senators who actually read the evidence against him voted to find him not guilty. So did the jury.

If he'd had a proper trial in the Senate he'd still be a judge.

He is an excellent congressman, and would be a fine chair. There are no serious suggestions that he has done anything the least bit shady in Congress, and the charges against him in Florida were tainted by racism: a lot of white lawyers didn't like being shown up in court by a smart black judge. Some of the good ol' boys on the bench weren't too comfortable either.

Hastings scares me, bribery charges aside he has issues with the highly paid assistants on his staff. One of which he recently took on a pricey trip to Belgium. The last thing we need is a sex scandal surrounding the newly empowered Democrats. Let's hear more about Reyes. Is there any chance he gets the job?

The nub concerning Harman, Hoyer and Lantos is their deep "acquaintanceship" with AIPAC. Since supporting the very existence of Israel is counter to the US's interests (Look where it has got us!), every member of both Houses should be required to affirm publicly, and then act to legislate, that he/she supports requiring Israel to conform to Sec Council Resolutions 242 and 338 and their succeeding refinements, together with the Right of Return with compensation to all of Palestine. This will demonstrate whether our elected Congressmen and Senators are Americans first or Zionist supporters first.

I frequently criticize Matthew Y. for taking the arguments of "neoconservatives" and "liberal hawks" at face value, arguing that they're just window dressing for unstated aims.

This post is a breakthrough for him, because he just cuts through the bullshit and names the names of the people Harman takes money from and who campaign for her. It's guilt by association, and quite rightly so. Admittedly, he doesn't go all the way to Haim Saban, but nice job fingering Baer as one of these people, too. I simply have to comment that this thread is the first I've ever read in which every comment was so persuasive that my opinion changed with each and every one. the only constant is that I think the fact of Hastings' impeachment alone is of little relevance. That was indeed an ugly political farce.

?? So? That was the information Baer putr forth to make the case for Harman. If that's indeed the primary case for Harman's fitness, competence & excellence, than what do you expect me to do? Cite them in a different order?

Well, this Democrat likes Jane Harmon. She's smart and great on TV. Hastings is not impressive. In additon to being impeached, apparently he has a huge amount of personal debt. That's from today's WaPo.
I don't know Reyes. It's funny; I watch talking heads all of the time, and I don't remember him at all. Maybe he's good, but I'll take someone who I know is an effective communicator over someone I don't know at all.

I think this from the post is in need of clarification:

It is pretty unusual for an investigation to be formally closed (or at least, that seems to be the premise of Cold Case). After all, who knows what tomorrow may bring in the way of new evidence?

But to write that Harman is "currently" under investigation looks wrong.

Israel should do this as soon as the Arab countries do the same for the Jews they kicked out.

Heck ... either the Arab countries chip in to help Israel out (given their sin of ommission in not resettling the Palestinians in 1948) or the European countries who resettled refugees forced out of their homelands in 1948 in order to prevent another WWII should get some sort of brownie points or something for going above and beyond the call of duty. If war-destroyed Germany had to accept Sudeten refugees, why can't we expect the same of Arabs?

I think it would be a horrible idea for Hastings to become Intelligence Commitee Chair. Whatever the reality (and it does seem as the evidence against Hastings is extremely strong), the perception of appointing an Chair impeached for bribery will be extrememly negative. It will be especially negative when Democrats have been campaigning against a "culture of corruption".

By the way...I'd like to ask people from resisting the temptation to comment about the Israeli-Arab conflict on this thread. Talking about Harman's and relationship AIPAC is appropriate (to be honest, I think any House Intelligence Committee Chair will have close ties to AIPAC, gives its influence in Washington), but I don't want to see this threatd devolve into a heated discussion about Israel.

Going with Hastings is asking for trouble.
